We asked him to share his experience as a seasoned real estate investor in the US, buying in Portugal. Here is his testimonial:

This is an informal video created primarily for our clients that are starting the real estate process with us. We need our clients to better understand the Portuguese market dynamics; however, we realized that are many others that plan to work with a buyer’s agent in the near future and needed to get this information as well.

Malika and Nikhil watched our videos on youtube, researched our site, and contacted our team in December 2021. By April 2022 they had their keys, and the entire process was by proxy!

As an exclusive buyer’s agent (EBA  –  a concept well known all around the world), we only work for the buyer. Traditional real estate agents in Portugal, although great in what they do, are double agents, meaning they work for both, the seller and the buyer; therefore, they will always try to be faithful to the property’s owner. Also, bank loan assistance and legal protection are handled by a third party, usually recommended by them.

In Portugal, it is standard that commissions are paid by the property owner to both agents involved. In our share, we work hard to make sure you will find a one-stop agency, where we negotiate the lowest price,  best bank rates, terms, and conditions while taking care of the property’s document evaluation and legal protection, with the CPCV (promissory contract) contingencies.  A contract gives us the ability to start representing you in Portugal.

  1. Property Inspection: A detailed report with pictures will be provided (included up to 1000€);
  2. Appraisal evaluation (included up to 250€);
  3. Legal Protection: Property Documents Evaluation and contract drafting, adding contingencies and revisions through our legal team (included on our EBA retainer fee);
  4. Property Search;
  5. Properties Selection;
  6. Virtual Guided Tour on selected properties;
  7. Pictures and videos from the final selection;
  8. Physical visit (if you can’t go, we make videos, take pictures of every possible issue that the house may present);
  9. If you feel that the property is the right one for you, we perform price research before making an offer (industry comparable);
  10. We make a verbal proposal and once it is accepted, you sign the written one;
  11. Credit Broker: Our credit facilitator prepares a dossier with all the information needed and send it to multiple banks to find the best deal for you and negotiate with multiple banks;
  12. Loan Approval;
  13. Once you are approved, the CPCV (Contract Promising to Buy and Sell) is prepared. We protect you with many clauses that are not standard on a regular CPCV document, with the goal to secure your down payment and make sure you have the best deal. The purchase is contingent on house inspection without structural problems, appraisal meeting the asking price and good property documentation without debts or liens;
  14. If you are not in Portugal, you will be requested to sign a power of attorney, so we can sign the CPCV on your behalf;
  15. No escrow accounts in Portugal: Additionally, you will be required to make a bank transfer to the property seller account to secure the down payment (usually 10%);
  16. If you have a loan, this is when the bank does the appraisal;
  17. Technical Inspection is done with the seller agent and Brint’s supervision;
  18. Documents Preparation;
  19. Deed Signature;
  20. Celebration with the Keys to your new Property in Portugal!!
  21. Property Management process starts: Open an Activity in the Finances, Get you a License, Prepare the First Aid Kit, Take Pictures, Prepare the Ads on the Rental Platforms, connect you with a rental agency that will help with the hospitality services and billing;

The duties of a traditional real estate agent in Portugal are the same as anywhere: Listing, showing, and ultimately selling property at the highest possible price on the behalf of its owner. After all, when the sale price is higher, so is the commission received by the realtor. BRINT Portugal acts as your representative, making sure you get the best property at the best value.

It is nothing new that real estate agents worldwide work for the seller of the property and are encouraged to reach the highest price for their clients.

It works the same in Portugal: Traditional brokers are paid directly by the seller and are therefore motivated to sell properties for the best price so they can get the highest possible commission. But in the Portuguese real estate market, it gets even more complex and dynamic. Because of the language barrier and the foreign buyer’s lack of local market knowledge, it is essential to have somebody right there providing impartial advice without a conflict of interest.

If something goes wrong before the closing, the seller’s broker may protect the sale even if it is not in your best interests as a buyer.

For example, let’s say the appraisal comes in lower than the sales price. In this instance, the seller’s broker has a huge conflict of interest: To make the highest sales commission, it’s in their best interest to protect the sale at the higher price!
